Lawsuit Over Retainer Fee Payment Revived Against Indiana Lawyer

An Indiana lawyer will have to face most of the claims brought by a married couple who accused him of legal malpractice in connection with a nonrefundable general retainer he accepted in marriage dissolution proceedings, according to a state appeals court.

Lori Della Valle went to see attorney Andrew Thompson’s because she was seeking a divorce from her husband Guy. Thompson’s assistant allegedly instructed Lori to use Guy’s debit card to make an $8,500 retainer payment while Guy was asleep.
