The owner of a Las Vegas apartment complex failed to convince a federal appeals court that a county ordinance barring unlicensed short-term property rentals is unconstitutional.
The $4,000 fine Diamond Sands Apartments LLC had to pay Clark County isn’t grossly disproportionate in violation of the Eighth Amendment’s excessive fines clause, the US Court of Appeals for the Ninth Circuit said in a Friday opinion affirming the lower court’s denial of injunctive relief.
