LA’s E-Scooter Location Collection Passes Constitutional Test

Los Angeles’ e-scooter permitting program, which requires e-scooter companies to disclose real-time location data for every device, survived a rider’s constitutional challenge on Monday when the Ninth Circuit found no reasonable expectation of privacy in the location information.

In 2018, the city began requiring e-scooter companies to provide location information through a system called Mobility Data Specification. MDS works with riders’ smartphones to compile real-time data on each e-scooter’s location by collecting the start and end points, and times, of each ride taken.
