Landlord Can’t Get Damages for Government Lease Payment Change

Virginia landlord GBA Associates LP isn’t entitled to damages for adjustments the government made in its lease payments to account for an overpayment of taxes.

GBA didn’t prove that the General Services Administration breached a lease when it altered its rent payments for a Falls Church property, Judge Kathryn C. Davis of the US Court of Federal Claims ruled. She previously determined the government was acting according to usual process when it adjusted its payments to GBA to recoup its overpayment.
