Lactose Intolerant Diners Sue Peet’s Coffee for Milk Surcharge

Peet’s Coffee Inc. was hit with a proposed class action alleging that its surcharges for non-dairy milk alternatives like oat, soy, and almond milk violate the Americans with Disabilities Act.

Customers in California, Massachusetts, and Texas filed the class action March 21 in the US District Court for the Northern District of California. They say lactose intolerance or milk allergies are disabilities and seek to represent a nationwide class, as well as state classes, of lactose intolerant consumers who have bought drinks or other Peet’s Coffee products within the last two years.
