Labor Department Nabs $1.1 Million in Home Care Overtime Dispute

The US Labor Department secured nearly $1.1 million for workers after a federal judge granted the agency a pretrial win in its overtime lawsuit against a home care firm.

The DOL put forth enough evidence to establish that WiCare Home Care Agency LLC and its owner ran afoul of the Fair Labor Standards Act’s minimum wage, overtime, and recordkeeping provisions, the US District Court for the Middle District of Pennsylvania said. The Wednesday opinion also rejected WiCare’s bid for a conference on the effect of a new US Supreme Court ruling on agency deference.
