Kyocera AVX Defeats Proposed Class Action Over 2023 Data Breach

Electronic-components maker Kyocera AVX Components Corp. defeated a proposed class action alleging it negligently failed to protect the personal information of more than 39,000 people that was exposed in a 2023 data breach.

Lead plaintiffs Jacob Stuart and Donald Dollar failed to show that they suffered concrete injuries sufficient to establish their standing to sue in federal court, Judge Jacquelyn D. Austin of the US District Court for the District of South Carolina said in an order filed March 7.

Austin granted Kyocera’s motion to dismiss the lawsuit without prejudice.
