Kroger Trims Pharmacist’s Age, Disability Discrimination Claims

Kroger LP shook off claims that it discriminated against a pharmacist due to his age and disability by transferring him to a floater position, but it must defend claims that his firing was motivated by discrimination.

Donald Henry alleged in his complaint that he was discriminated against, retaliated against, and discharged on account of his age in violation of the Age Discrimination in Employment Act and on the basis of his disability in violation of the Americans with Disabilities Act.
