Kroger Co. Defeats Cold-Pressed Avocado Oil Mislabeling Lawsuit

A woman alleging Kroger Co. mislabeled its Cold-Pressed Avocado Oil failed to include enough facts showing the product was adulterated or that the product was advertised as “pure,” a federal judge said.

Lead plaintiff Sissy McConnon’s allegations that third-party laboratory tests showing the private label product’s content profiles were inconsistent with “pure avocado oil” didn’t meet pleading standards, the US District Court for the Central District of California said June 21.

McConnon alleged the tests found the fatty acid and sterol profiles of the Kroger product were inconsistent with “pure” avocado oil.
