Krave Botanicals, which makes and distributes kratom products, again failed to fully shed a lawsuit from consumers alleging the company failed to disclose its products are addictive when a California federal judge rejected arguments that the suit was preempted by federal law.
But the US District Court for the Southern District of California did dismiss claims that the consumers could advance as a nationwide class, finding that there is too much variance in consumer protection laws across all 50 states.
The ruling by Judge Gonzalo P. Curiel comes after he largely denied a motion to dismiss by Krave last fall. ...
