Kraft Heinz Can’t Shake Mac & Cheese Preservatives False-Ad Suit

Kraft Heinz Co. failed to convince a federal judge to dismiss claims it deceptively advertised its macaroni and cheese products as free from artificial flavors, preservatives, and dyes despite containing citric acid and sodium phosphate.

The US District Court for the Northern District of Illinois on Wednesday rejected Kraft Heinz’s argument that the consumers failed to establish the citric acid used in the products was artificial.

The food company compared the proposed class action to a similar suit where the plaintiffs’ claims failed because they generally alleged it wasn’t economically feasible for food producers to use natural citric acid.
