Kombucha Maker Better Booch Beats False Labeling Suit, for Now

Better Booch LLC won dismissal of a proposed consumer class action alleging the kombucha maker dupes consumers into believing its products contain real fruit juice.

The claims brought under California’s consumer protection laws fail because, “as a matter of law, the public is not likely to be deceived,” Judge Dana M. Sabraw of the US District Court for the Southern District of California said.

“The front of the can taken in context with the back label makes clear that the product does not contain pear juice,” Sabraw said.
