Koch Project Solutions Loses Bid to Lift Stay in Noncompete Row

Koch Project Solutions LLC, a unit of Koch Industries Inc., lost its bid to move forward a lawsuit against Triten Corp. over noncompete agreements after the Fifth Circuit affirmed an order pausing the case while related state-court litigation plays out.

A district court has broad discretion to stay federal proceedings pending a state court action, and while the existence of a parallel state court action that will resolve all of the underlying issues isn’t the only factor in the analysis, it is an important one, the US Court of Appeals for the Fifth Circuit said Friday.
