Kipling Can’t Shake Majority of Deceptive Pricing Class Action

A Kipling Apparel Corp. consumer sufficiently alleged that the value of the apparel brand’s discounts was improperly inflated, a federal court ruled in mostly denying a motion to dismiss.

Christina Calcagno said in a proposed class action that at its outlet stores, Kipling engaged in a scheme to defraud customers by misrepresenting the true market value of its products, leading consumers to purchase more than they otherwise would.
