King & Spalding Seeks Dismissal of Diverse Hiring Program Suit

A lawsuit attacking King & Spalding’s promotion of a diversity mentorship program is “misguided” and should be dismissed, the firm said, because the plaintiff never applied to the program.

The motion to dismiss the case comes in response to a complaint filed with the US District Court for the District of Maryland, in which Baltimore lawyer Sarah Spitalnick alleged the firm violated federal law when it posted an advertisement seeking non-White or non-heterosexual candidates to be summer associates.

She didn’t apply, asserting that to do so would have been a “futile gesture.”
