Kashi Strawberry Breakfast Bar Labels Could Mislead Consumers

A consumer alleging Kashi Sales LLC deceives consumers into thinking its “Ripe Strawberry Soft Baked Breakfast Bars” have more strawberry than supposed lesser fruit ingredients saw his false-ad suit move ahead on Tuesday.

Although it’s a “close call,” the US District Court for the Southern District of New York said Peter Hoffman has plausibly alleged a reasonable consumer might believe strawberries were the predominant fruit ingredient when the bars have more apple and pear.

Kashi’s argument that “ripe strawberry” is presented as the product’s flavor—not as an ingredient—was rejected by Judge Vincent L. Briccetti.
