Kansas state officials went before the Tenth Circuit for a second time to argue that a law barring third parties from sending mail ballot applications to voters containing some of their information already filled in is constitutional.
Judge Joel M. Carson III questioned attorneys for the voting rights groups that challenged the law about how much of an impact the statute actually has on their speech advocating for mail voting. “It’s not their speech in toto filling in these blanks,” Carson said. “It’s a small part of a much larger message” that goes into the mailings.
