The US Supreme Court declined Monday to review whether a North Carolina charter school’s requirement that female students wear skirts, jumpers, or skorts was unconstitutional state action.
The Fourth Circuit opened a circuit split when the full court ruled June 14 that the school’s uniform rules for girls violated the equal protection clause, Charter Day School told the justices in its petition seeking review. North Carolina delegated some of its constitutional responsibility to provide a free public education when it granted a charter to the school, making the school a state actor, the court said.
