Justices Seek Government Input on Wage Exemption Proof Burden

The US Supreme Court asked for one of the federal government’s top lawyers to weigh in before it decides whether to grant a petition on companies’ burden of proof for taking advantage of Fair Labor Standards Act exemptions.

The case turns on what a food products wholesaler says is a circuit split over the type of evidence required, but the company’s workers say the standard of proof used won’t make a difference in their case. The Supreme Court called for the views of the US Solicitor General Monday.
