Justices Decline Review in Tech Mahindra Asian-Preference Suit

The US Supreme Court on Monday declined to review Tech Mahindra (Americas) Inc.'s challenge to a White American worker’s time to sue over alleged pro-Asian bias both individually and as part of a proposed class.

The US Court of Appeals for the Third Circuit joined the wrong side of a circuit split, the software company told the justices, when it ruled that the plaintiff’s statute of limitations had been tolled by an unsuccessful attempt to add him to a proposed amended complaint in another jurisdiction despite that amendment having been made without permission.
