An older female psychiatrist’s disparate impact lawsuit against the Department of Justice will continue after a district court denied a motion to dismiss.
Jane D. DiCocco, 67-year-old woman who failed the Bureau of Prisons’ required physical abilities test declined to take a second test within a 24 hour time-frame because she believed she couldn’t pass, according to her lawsuit filed at the US District Court for the Eastern District of Virginia.
