Judges Prod GeoSnapShot Over Bid to Arbitrate Biometric Suit

An attorney for consumers alleging that online photo platform GeoSnapShot PTY Ltd. violated the Illinois biometric privacy law was met with skeptical questions from a federal appellate panel over the company’s effort to take the plaintiffs’ claims to arbitration.

GeoSnapShot’s attorney Thomas M. Wolf told the US Court of Appeals for the Seventh Circuit that the district court should have sent the central question of the proposed class action—whether the company could enforce an arbitration agreement despite being a non-party to it—to an arbitrator rather than making its own ruling.
