Jones Day Must Disclose Decades-Old Memo in Parental Leave Suit

Jones Day must hand over a decades-old memo concerning changes to its parental leave-policy to a couple of married former associates suing it for alleged sex bias against biological fathers, a federal judge ruled Wednesday.

The firm waived attorney-client privilege regarding the 1993 document by offering the authoring human resources director’s advice, as an attorney, to Jones Day’s then-=managing director as its nondiscriminatory justification when it sought to get the suit dismissed without a trial, and in opposition to the couple’s cross-motion for summary judgment, the US District Court for the District of Columbia said.
