The owner of a Manhattan restaurant called Jolene lost its bid for a preliminary injunction against a Brooklyn cocktail bar called Jolene Sound Room while its trademark infringement suit is pending.
The restaurant owner, Marlinspike Hall LLC, “failed to demonstrate a likelihood of success on the merits of establishing a likelihood of confusion” between its “Jolene” trademarks and the bar’s use of the name, Judge J. Paul Oetken of the US District Court for the Southern District of New York said on Tuesday.
