Joint Juice Consumers Awarded $8.3 Million in False-Ad Damages

Premier Nutrition Corp. was ordered to pay $8.3 million in statutory damages to consumers of its now-discontinued Joint Juice product after a federal judge reduced the plaintiff’s requested total award tenfold.

The US District Court for the Northern District of California on Monday said an $83 million damage award is “grossly punitive and thus wholly disproportionate to the legislative goals” of the state consumer protection statute the claims were brought under.

Named plaintiff Mary Beth Montera alleged Premier Nutrition misrepresented the benefits of the product. She brought her claims under two separate sections of the New York General Business Law ...
