Hair care company John Paul Mitchell Systems defeated a proposed class action alleging its Invisiblewear Brunette Dry Shampoo product was contaminated the carcinogen benzene.
The consumers failed to show that the specific products they purchased contained benzene and couldn’t show that they suffered a concrete and particularized injury, the US District Court for the Northern District of Illinois said Monday, dismissing the suit without prejudice. The consumers alleged that testing from independent laboratory Valisure showed there was a risk that all lots of the dry shampoo contained benzene.
