Jo-Ann Loses Bid to Throw Out Workers’ Pay-Delay Allegations

Jo-Ann Stores LLC must face accusations that it failed to pay store workers performing manual labor weekly as required under state law, a federal judge in New York said.

The craft store chain argued that the New York law at issue doesn’t provide a private cause of action, so the workers can’t sue under it. Although the state’s highest court hasn’t settled the matter, it would likely “recognize a private right of action here,” allowing the workers’ suit to move forward, the US District Court for the Western District of New York said.
