To-Ricos Ltd. holds the rights to the “Pollo Picú” trademark in the sale of fresh chicken, a federal appeals court held after a long-running dispute with Puerto Rico-based company Productos Avícolas del Sur Inc.
The Picú mark was abandoned by PAS as of April 2016 and To-Ricos established its priority to use the mark, at the latest, by June 2019 when it began selling products under the mark, the US Court of Appeals for the First Circuit said Thursday, affirming a lower court decision siding with To-Ricos.
