A divided federal appeals court Monday declined to revive jazz saxophonist Steve Coleman’s lawsuit alleging a former pupil defamed him in her #MeToo-inspired letter about their “complicated sexual relationship.”
The 2-1 decision by the US Court of Appeals for the Second Circuit provides guidance on when labeling behavior as “sexual harassment” might cross the line from on nonactionable expression of opinion into assertions of fact that could be legally actionable.
