Janie & Jack Looks to Fend Off Web-Tracking Arbitration Claims

Children’s clothing retailer Janie & Jack LLC asked a federal court to prevent 2,408 consumers from bringing individual arbitration claims against it over its alleged use of online tracking tools on its website in violation of California privacy laws.

The claimants couldn’t invoke the arbitration agreement in the retailer’s terms of service because their claims didn’t involve a dispute arising from a transaction, and because they didn’t show that they had accepted the arbitration agreement when they used the website, according to the company’s complaint filed Monday in the US District Court for the Northern District of California.
