Children’s clothing retailer Janie and Jack LLC will face consumer privacy claims over its use of website data-tracking tools as a proposed federal class action rather than through thousands of individual arbitrations.
The company had filed a lawsuit attempting to block a mass-arbitration bid on behalf of more than 2,400 claimants led by plaintiff’s firm Zimmerman Reed LLP, but dropped the suit after the claimants agreed to proceed by a class action, according to a notice of voluntary dismissal filed May 23 in the US District Court for the Northern District of California.
