A Jan. 6 rioter convicted of corruptly obstructing Congress’s certification of the electoral count of the 2020 presidential election, among other offenses, won an appeal to undo his sentence Friday.
The US Court of Appeals for the D.C. Circuit rejected Larry Brock’s challenges to the underlying conviction but agreed the district court made a mistake when it applied a three-level sentencing enhancement for interfering with the “administration of justice.”
The enhancement doesn’t apply to interference “with the legislative process of certifying electoral votes,” Judge Patricia A. Millett said for the court.
