J&J Unit Mentor Beats Appeals in More Breast Implant Suits

Johnson & Johnson’s unit Mentor Worldwide LLC defeated more breast implant appeals, as the Ninth Circuit said the women’s suits failed to raise non-preempted claims linking their harm to the company’s alleged wrongful conduct.

Kate Nunn, Aluvia Solano, and April Zimmerman alleged their MemoryGel silicone implants ruptured and caused numerous health problems.

But their suit, as well as similar suits by other women, were properly dismissed, the U.S. Court of Appeals for the Ninth Circuit said Feb. 5 in four nearly identical unpublished opinions.
