J&J Hernia Mesh Lawsuit Filed Too Late, Appeals Court Affirms

Johnson & Johnson and its Ethicon Inc. unit defeated a man’s appeal in a hernia mesh suit, as the Third Circuit affirmed Friday that his suit was filed too late under governing North Carolina law.

Michael Bond had a Prolene 3D hernia mesh device implanted on March 17, 2009. He underwent surgery on April 26, 2019, to have the mesh removed and replaced.

His March 2021 suit is barred under the six-year North Carolina product liability statute of repose, which started when he received the mesh, the US Court of Appeals for the Third Circuit said in a nonprecedential opinion. ...
