Truck-body manufacturer J.B. Poindexter & Co. convinced a magistrate judge to recommend dismissing a proposed class action alleging it negligently failed to protect the personal information of employees disclosed in a 2024 data breach.
Lead plaintiff Thomas Perlaki suffered a concrete injury sufficient for standing in the form of emotional distress but failed to adequately state any of the claims of the lawsuit, Magistrate Judge Andrew M. Edison of the US District Court for the Southern District of Texas said Monday.
Edison’s recommendation is subject to approval by Judge George C. Hanks Jr.
