Bank Hapoalim BM must face an executive assistant’s lawsuit alleging its CEO discriminated against her based on her sex after she complained about him exposing the office to Covid-19, the Second Circuit ruled Tuesday.

The woman’s forced transfer to a different department following her complaint could be an adverse employment action under the US Supreme Court’s decision in Muldrow v. City of St. Louis, a unanimous appeals panel said.
