Iowa Criminalizing Illegal Alien Reentry Blocked by 8th Cir.

A federal appeals court blocked an Iowa law that criminalizes the presence in the state of aliens who have reentered the country illegally, saying federal law preempted it.

Iowa’s law must be blocked because the US has “broad, undoubted power” over the subject of immigration and the status of aliens, Judge Duane Benton said for the US Court of Appeals for the Eighth Circuit, affirming a preliminary injunction to stop the law’s enforcement.
