Insurer Must Defend Landry’s Inc. in $20 Million Data Breach Row

The Insurance Co. of the State of Pennsylvania must defend retail property operator Landry’s Inc. in litigation over a data breach that caused more than $20 million in losses to Visa and MasterCard, the Fifth Circuit held Wednesday.

Landry’s, based in Houston, owns and operates restaurants including Bubba Gump Shrimp Co., as well as hotels and casinos. It used JPMorgan Chase Bank unit Paymentech LLC to process Visa and MasterCard payments at its properties.
