Insurance Brokerage Escapes Some of Trade Dress, Contract Suit

Appalachian Underwriters Inc. won partial dismissal of a lawsuit alleging it cloned Slice Insurance Technologies Inc.'s proprietary online insurance platform without authorization.

The US District Court for the Southern District of New York Monday dismissed Slice’s breach of contract claim insofar as it’s based on the tech company’s terms of use, as well as Slice’s federal claim for trade dress infringement.

The complaint doesn’t allege that Appalachian signed up for an account, clicked an acceptance box, or otherwise agreed to the terms of use, so it failed to allege a contract based on those terms existed, Judge Lorna G. Schofield ...
