Ryse Up Sports Nutrition LLC was granted dismissal without prejudice of a suit from Alani Nutrition LLC accusing it of infringing a viral photo created to market a drink Alani made in collaboration with Kim Kardashian.
Judge Charles P. Kocoras, of the US District Court for the Northern District of Illinois, on Jan. 12 said Alani didn’t show the court had general personal jurisdiction over Ryse Up or Paige Hathaway, a social media influencer featured in the allegedly infringing photo, and dismissed the suit “subject to refiling in an appropriate forum.”
