Insider Defeats ‘Pen Register’ Suit Over IP-Address Disclosure

Online news service Insider Inc. defeated a proposed class action alleging it shared the IP addresses of website visitors with third parties in violation of the “pen register” provisions of the California Invasion of Privacy Act.

Lead plaintiff Jonathan Gabrielli’s allegations failed to show he suffered a concrete injury sufficient for standing to sue in federal court, Judge Edgardo Ramos of the US District Court for the Southern District of New York said Tuesday.

Ramos dismissed the lawsuit without leave to amend.
