Inmate Not Owed Jury Trial for ‘Ordinary’ Release Revocation

A convicted felon who had his supervised release revoked after committing further crimes isn’t entitled to a jury trial under the US Constitution, a federal appeals panel ruled Monday.

Seldrick Carpenter’s appeal bid was rejected after the US Court of Appeals for the Seventh Circuit ruled his situation was an “ordinary revocation” and that he wasn’t entitled to another jury trial. The three-judge panel said Carpenter’s case didn’t fall under a narrow 2019 holding by the US Supreme Court in United States v. Haymond, a case that specified when certain revocations trigger the Sixth Amendment.
