Ohio Foreign Election Money Law Unfrozen by Split Appeals Panel

An Ohio law preventing foreign contributions to local elections will continue operating as intended after a split federal appeals court ruled Tuesday a lower court injunction blocking aspects of the legislation is likely improper.

The US Court of Appeals for the Sixth Circuit granted an emergency stay on a preliminary injunction blocking a portion of Ohio’s Section 121 statute, according to the majority opinion. The majority ruled that the opponents to the law failed to meet the necessary burden to warrant an injunction on the law passed earlier this year.
