A simmering patent dispute between two producers of fabric playhouses inflated by box fans hit a boil Monday, as Tech-E Inc. asked a California federal court to nix two patents and a trademark held by XM Works Inc., maker of the Air Fort.
Tech-E, which sells the Skywin Air Tent, told the US District Court for the Southern District of California that US Patent Nos. 11,318,393 and 10,619,375—each covering a “hovering air fort"—are invalid as disclosed by prior art, and if they do stand, the Air Tent doesn’t infringe the patents.
