A radiology group accused of negligence leading to a patient’s death will face a hospital’s suit for partial repayment of its settlement with the patient’s family because Indiana’s medical malpractice law doesn’t bar the claim, the state’s top court said.
Procedural protections in Indiana’s Medical Malpractice Act, including a two-year time limit on bringing cases, don’t apply in a breach of contract suit to enforce an indemnification clause, the Indiana Supreme Court said.
