Indiana Company Proves Jurisdiction Error by Iowa Federal Court

An Indiana trucking company showed that a federal district court erred when it concluded that it has jurisdiction over a lawsuit accusing the company of violating Iowa fraud protection laws, the Iowa Supreme Court said.

A foreign corporation, like defendant CRST Specialized Transportation Inc., doesn’t consent to personal jurisdiction by registering to do business in Iowa, appointing an agent for service of process in Iowa, or receiving service through an agent, Justice David N. May said in a unanimous Dec. 19 opinion, in which all justices joined. A federal district court certified this jurisdictional question at CRST’s request.
