An Indiana public school teacher failed to convince a federal appeals court to block a state law prohibiting any instruction on human sexuality to students below fourth grade.
Kayla Smiley failed to show the law is likely overbroad or unconstitutionally vague enough to warrant a preliminary injunction, the US Court of Appeals for the Seventh Circuit said Tuesday.
Smiley, who was set to start teaching first through third graders in Indianapolis when the law was passed in 2023, alleged the terms “instruction” and “human sexuality” aren’t defined in the legislative text.
