A Palau native who’d won a US appeals court ruling staving off his removal following a felony conviction in the state of Washington, has seen that victory now reversed by an en banc panel.
The US Court of Appeals for the Ninth Circuit, in a ruling issued Thursday, overturned the three-judge panel’s conclusion that the Washington law under which he was pleaded guilty, and was deemed removable by the Board of Immigration Appeals, didn’t amount to an aggravated felony warranting removal under federal law.
