An immigrant, who was ordered to be removed after a remote hearing, must file his appeal of the Board of Immigration Appeals’ decision in the federal appeals court from which his notice to appear originated, the Third Circuit said Wednesday.
Elfido Gonzalez Castillo received a notice to appear in the immigration court in Ohio; he attended hearings virtually from a correctional facility in Pennsylvania where he was detained; and the immigration judge conducted his final hearing virtually while physically present in Virginia.
