Illuminate Education Spared by Top State Court Over Data Breach

Illuminate Education Inc. defeated a proposed class action alleging it negligently failed to protect the personal and health information of students in a 2022 data breach.

The California Supreme Court said the plaintiff failed to adequately plead his claims under the California Confidentiality of Medical Information Act or the Customer Records Act. The justices remanded the case Thursday to the California Court of Appeals to determine whether the plaintiff should be given leave to file an amended complaint.
